In recent years entry/exit-related crimes have been increasing, especially cases of organized illegal entry and exit, obtaining entry/exit documents by fraud, forging entry/exit documents, selling and buying entry/exit documents. To eliminate and check the spread of such criminal cases, the Ministry and of Public Security promulgated on February 4th, 2002 the Circular by the Ministry of Public Security on the Adjustment of Jurisdiction over Some of the Entry/Exit-Related Crimes (GT[2002]7). According to this circular, crimes of the following categories will be dealt with by the entry/exit administration:  obtaining exit documents (Article 319, PRC Criminal Law), supplying forged or altered entry/exit documents (Article 320, PRC Criminal Law), selling entry/exit documents (Article 320, PRC Criminal Law), organizing illegal crossing of the national border (frontier) (Article 318 PRC Criminal Law), and transporting other persons in illegally crossing the national border (frontier). The police force’s entry/exit control department exercises administration over entry and exit and the power to investigate entry/exit-related criminal cases. At this moment and in the future, we have before us the important task of cracking down on entry/exit-related crimes.

 

“The entry/exit forbidden zone” means entry/exit-related activities which, according to Chinese law, Chinese citizens, organizations, enterprises, institutions and other social bodies (and also foreigners, stateless persons, foreign legal persons, foreign social bodies), are not supposed to, or are forbidden to engage in. These mainly refer to activities in violation of Chinese laws and regulations on entry and exit control and/or Articles 318, 319, 320, and 321 of the People’s Republic of China Criminal Law.  Such activities include:

l      Holding and using invalid, forged, altered entry/exit documents or documents belonging to other people;

l      Forging, altering, transferring, selling and buying entry/exit documents;

l      Obtaining entry/exit documents by fraud;

l      Making arrangements and providing means of transport for others to cross the national border (frontier)

l      Illegally crossing the national border (frontier);

l      Harming the security, prestige and interest of the state.
