Article 22 of the Rules Governing the Implementation of the Law of the People’s Republic of China on Entry and Re-entry of Chinese Citizens:  If the holder of a PRC passport or other entry/exit documents falls under any of the following categories, his/her passport or other entry/exit documents shall be withdrawn or annulled:

(I) The holder of the documents have been returned to China after illegally entered and stayed in a foreign country;

(II) The holder uses the documents in frauds and swindling;

(III) The holder is engaged in activities harmful to the security, prestige and interests of the state. Such withdrawal or nullification shall be carried out by the organ that issued the documents or a higher-level organ.

Article 15 of Regulations of the People’s Republic of China Regarding Frontier Inspection: When people of the following categories enter or exit China, frontier inspection officials have the power to restrict the range of their activities, look into their cases or send them to relevant organs to be dealt with there:

(I) Those suspected of holding and using entry/exit documents belonging to other persons;

(II)  Those suspected of holding and using forged or altered entry/exit documents;

(III) Those who, according to notice from the Ministry of Public Security, the Ministry of National Security, or public security or national security organs of any province or municipality directly under the central government, are suspected of having committed crimes;

(IV) Those suspected of being potentially harmful to the security and interest of the state or to social order.

Article 29 of Regulations of the People’s Republic of China Regarding Frontier Inspection:  It is not allowed to take documents, materials and other things containing state secrets out of China (or across the frontier). When discovering such documents, materials and others things, the border check post shall confiscate them and duly penalize the persons in question in accordance with relevant laws and administrative regulations.


Article 8 of Provisional Regulations Regarding Chinese Citizens’ Travels to the Hong Kong and Macao Regions for Personal Affairs:  Applicants for permission to go to Hong Kong or Macao who come under the following categories shall not be allowed to exit:

(I) The defendant or suspect of a criminal case;

(II) Those who, by instructions from a people’s law court, cannot leave China owing to some unsettled lawsuit;

(III) Those who have not served the full term of their imprisonment:

(IV) Those who are under rehabilitation through labor;

(V) Those whose exit from China, the competent department of the State Council believes, will do great harm to the security and interest of the state;


Article 13 of Provisional Regulations Regarding Chinese Citizens’ Travels to the Hong Kong and Macao Regions for Personal Affairs: Applications for permission to go to Hong Kong or Macao from applicants who come under any of the following categories shall not be approved:

(I) Those who fall under the categories listed in Article 8 of People’s Republic of China Law on Exit and Reentry of Chinese Citizens;

(II) Those who do not fit in with the provisions in Articles 7 and 8 of the present Regulations;

(III) Those who cheat entry/exit administrations under public security organs by fabricating information or presenting false papers.


Article 12 of Regulations Regarding Chinese Citizens’ Travels to the Taiwan Region: Applications for permission to go to the Taiwan region from applicants who come under the following categories shall not be approved:

(I) The defendant or suspect of a criminal case;

(II) Those who, by instructions from a people’s law court, cannot leave China owing to some unfinished lawsuit;

(III) Those who have not served the full term of their imprisonment:

(IV) Those who are under rehabilitation through labor;

(V) Those whose exit from China, the competent department of the State Council believes, will do great harm to the security and interest of the state;

(VI) Those who cheat by fabricating information and submitting false papers.

 

Article 22 of Regulations Regarding Chinese Citizens’ Travels to the Taiwan Region: Applications for permission to come to the mainland by Taiwan residents shall not be approved if the applicants:

(I) Are believed to have committed crimes;

(II) May, it is believed, engage in activities harmful to the state’s security and interests after entering the mainland;

(III) Are believed to have cheated by fabricating information or submitting false papers;

(IV) Are suffering from mental illnesses or serious contagious diseases, with the exception of those who have to come to the mainland for medical treatment or other unusual purposes.

Article 24 of Regulations Regarding Chinese Citizens’ Travels to the Taiwan Region: In the following case, officials of border check posts have the power to prevent the persons in question from entering or exit China:

(I) The traveler does not carry valid travel documents;

(II) The traveler carries invalid travel documents, such as forged or altered ones;

(III) The traveler refuses to present his/her travel documents for inspection;

(IV) The traveler is forbidden to enter or exit China by Articles 12 and 22 of the presents Regulations.

 

Article 31 of Regulations Regarding Chinese Citizens’ Travels to the Taiwan Region:

If the holder of a permit for a mainland resident to travel in Taiwan or for a Taiwan resident to travel in the mainland comes under the categories mentioned in Article 12 and 22, then his/her travel permit shall be withdrawn or annulled.

Article 40 of Regulations Regarding Chinese Citizens’ Travels to the Taiwan Region: In case Taiwan residents traveling in the mainland have violated the present Regulations or other regulations, or committed other crimes, besides giving them the punishment laid down in the present Regulations and other laws and regulations, the public security organ shall have the power to shorten their stay in the mainland, order them to leave the mainland within a specified time, or deport them. Those who come under the categories mentioned in Article 22 of the present Regulations shall immediately be deported.

Article 12 of Law of the People’s Republic of China on Entry and Exit of Aliens: An alien considered a potential threat to China’s national security and public order shall not be permitted to enter China.

Article 16 of Law of the People’s Republic of China on Entry and Exit of Aliens:   In the case of an alien who fails to abide by Chinese law, his period of stay in China may be shortened or his status of residence may be annulled by the competent authorities of the Chinese Government.


Article 7 of Rules Governing the Implementation of the Law of the People’s Republic of China on Entry and Exit of Aliens:  Aliens coming under the following categories shall not be allowed to enter China:

1)        An alien expelled by the Chinese Government and before expiry of the period when his/her re-entry is prohibited;

2)        An alien considered likely to engage in terrorism, violence or subversion upon entering China;

3)        An alien considered likely to engage in smuggling, drug trafficking or prostitution upon entering China;

4)        An alien suffering from mental disorder, leprosy, AIDS, venereal diseases, contagious tuberculosis or other infectious diseases;

5)        An alien who cannot guarantee to cover his/her stay in China;

An alien considered likely to engage in other activities prejudicial to China’s national security and interests.
