Article 14 of Law of the People’s Republic of China on Exit and Reentry of Chinese Citizens: Whoever, in violation of the provisions of this law, enters or exits China, or forging, altering, transferring, or using other persons’ entry/exit documents shall be detained by the public security organ for not longer than 10 days; if the offence is serious enough to constitute crimes, the offender shall be brought to justice in accordance with law.


Article 24 of Rules Governing the Implementation of the Law of the People’s Republic of China on Entry and Re-entry of Chinese Citizens: Whoever forges, alters, transfers, buys or sells entry/exit documents shall be detained for not longer 10 days; if the offence is serious enough to constitute crimes, the offender shall be brought to justice in accordance with People’s Republic of China Criminal Law and Supplementary Decisions Enacted by the Standing Committee of the National People’s Congress Regarding the Punishment of Criminals Who Make Arrangements and Provide Means of Transport for Other Persons to Illegally Cross the National Border (Frontier).


The crimes of providing forged or altered entry/exit documents and of buying or selling entry/exit documents.


Article 320 of People’s Republic of China Criminal Law:  Whoever provides another person with a counterfeit or altered passport, visa or other exit and entry certificates or sells passports, visa or other exit and entry certificates shall be sentenced to fixed-term imprisonment of not more than five years and shall also be fined; if the circumstances are serious, he shall be sentenced to fixed- term imprisonment of not less than five years and shall also be fined.


Article 3 of Supplementary Decisions Enacted by the Standing Committee of the National People’s Congress Regarding the Punishment of Criminals Who Make Arrangements and Provide Means of Transport for Other Persons to Illegally Cross the National Border (Frontier): Whoever provides forged or altered entry/exit documents, such as passports and visas, or buys or sells such entry/exit documents as passports and visa, shall be sentenced to not longer than 5 years imprisonment and shall also be fined. Where the circumstances are serious, the offender shall be sentenced to longer than 5 years in prison and shall also be fined.

Article 17 of Provisional Regulations Regarding Chinese Citizens’ Travels to the Hong Kong and Macao Regions for Personal Affairs: Whoever forges, alters or transfers such documents as Hong Kong and Macao Travel Permit, Permit for Traveling to Hong Kong and Macao, Permit for Hong Kong and Macao Compatriots to Travel in the Mainland, or Entry/Exit Permit shall be detained for not longer than 5 days. Where the circumstances are serious, the defender shall be brought to justice in accordance with the provisions of the People’s Republic of China Criminal Law.


Article 34 of Regulations Regarding Chinese Citizens’ Travels to the Taiwan Region: Whoever forges, alters, transfers, or resells travel documents at a high profit may, in addition to being punished in accordance with Rules Governing the Implementation of the Law of the People’s Republic of China on Entry and Re-entry of Chinese Citizens, of 500 to 3000 RMB, alone or with other punishments.


Article 29 of Law of the People’s Republic of China on Entry and Exit of Aliens: Whoever illegally enters, leaves, resides or stops over in China, or travels to places not open to aliens without valid travel permit or forges, alters, misuses or negotiates entry or exit certificate in contravention of the provisions of the present Law may be subjected to such penalties as warning, fine or detention for not more than ten days, by the public security organs at and above county level. Offenders whose violations are serious enough to constitute crimes shall be prosecuted in accordance with law.


If an alien being fined or detained by a public security organ refuses to accept a penalty, he may, within fifteen days of receiving notification, appeal to the next higher public security organ, which shall make the final judgment, and/or may file a suit directly in a local people’s court.

Article 30 of Law of the People’s Republic of China on Entry and Exit of Aliens:  The Ministry of Public Security may order serious offenders as listed in Article 29 of the present Law to leave the country within a time limit or may expel them.


Article 47 of Rules Governing the Implementation of the Law of the People’s Republic of China on Entry and Exit of Aliens:  Aliens who forge, alter, misuse, transfer, buy or sell visas or certificates shall have the said visas, certificates and illicit income revoked or confiscated and may be fined from 1,000 to 10,000 yuan or detained from 3 to 10 days, and may at the same time be ordered to leave the country within a specified time, and those whose offences are serious enough to constitute a crime shall be prosecuted for their criminal responsibility according to law.
