Article 9 of Law of the People’s Republic of China on Exit and Reentry of Chinese Citizens: Frontier inspection organs shall have the power to prevent Chinese citizens who fall under any of the categories below from leaving China, and to handle the case in accordance with relevant laws:

(I) Those who hold and use invalid exit documents;

(II) Those who hold and use exit documents belonging to other persons;

(III) Those who hold and use forged or altered exit documents.


Article 15 of Rules Governing the Implementation of the Law of the People’s Republic of China on Exit and Reentry of Chinese Citizens: Frontier inspection organs shall have the power to prevent Chinese citizens who fall under any of the categories below from leaving or reentering China:

(I) Those who do not carry a PRC passport or other exit and entry documents;

(II) Those who carry an invalid PRC passport or other invalid exit and entry documents;

(III) Those who carry a forged or altered passport or other document, or carry a passport or document that belongs to another person.

(IV) Those who refuse to present their documents for examination. Those who fall under the second and third categories of the preceding article shall be dealt with in accordance with provisions of Article 23 of the present Regulations.


Article 23 of Rules Governing the Implementation of the Law of the People’s Republic of China on Exit and Reentry of Chinese Citizens: Invalid documents such as forged or altered ones, or documents belonging to other persons carried by Chinese citizens when they try to exit or reentry China will be confiscated. In addition, these people shall be served a warning or detained for not longer than 5 days; where the circumstances are so serious as to constitute crimes, the offenders shall be brought to justice in accordance with Supplementary Decisions Enacted by the Standing Committee of the National People’s Congress Regarding the Punishment of Criminals Who Make Arrangements and Provide Means of Transport for Other Persons to Illegally Cross the National Border (Frontier).


Article 8 of Regulations of the People’s Republic of China Regarding Frontier Inspection: Frontier inspection posts have the power to prevent those who fall under any of the categories below from exiting or reentering China:

(I) Those who do not carry exit/reentry documents;

(II) Those who carry invalid exit/reentry documents;

(III) Those who carry exit/reentry documents belonging to other persons;

(IV) Those who carry forged or altered exit/reentry documents;

(V) Those who refuse to be inspected by frontier inspection officials;

(VI) Those who do not pass through the designated ports;

(VII) Those who, by instructions from the Ministry of Public Security under the State Council or from the Ministry of National Security, are not allowed to exit or reenter China;

(VIII) Those who are forbidden by relevant laws or administrative regulations to exit or reenter China. When people falling under the third or fourth categories mentioned above, or Chinese citizens falling under the seventh or eighth categories try to exit or reenter China, frontier inspection officials may withdraw or confiscate the exit/reentry documents they carry.

Article 15 of Regulations of the People’s Republic of China Regarding Frontier Inspection: When people of the following categories enter or exit China, frontier inspection officials have the power to restrict the range of their activities, look into their cases or send them to relevant organs to be dealt with there:

(I) Those suspected of holding and using entry/exit documents belonging to other persons;

(II)  Those suspected of holding and using forged or altered entry/exit documents;

(III) Those who, according to notice from the Ministry of Public Security, the Ministry of National Security, or public security or national security organs of any province or municipality directly under the central government, are suspected of having committed crimes;

(IV) Those suspected of being potentially harmful to the security and interest of the state or to social order.


Article 32 of Regulations of the People’s Republic of China Regarding Frontier Inspection: Travelers trying to enter or exit China who come under any of the following categories shall be fined not less than 500 yuan but not more than 2000 yuan RMB or be detained in accordance with relevant laws and administrative regulations:

(I) Those who do not carry entry/exit documents;

(II) Those who carry invalid entry/exit documents;

(III) Those who carry entry/exit documents belonging to other persons;

(IV) Those who carry forged or altered entry/exit documents.


Article 20 of Provisional Regulations Regarding Chinese Citizens’ Travels to the Hong Kong and Macao Regions for Personal Affairs: In the following cases, border check post officials have the power to withhold entry or exit of the traveler:

(I) The traveler does not carry a Travel Permit for Mainland Residents to Go to Hong Kong and Macao, or Travel Permit for Hong Kong and Macao Compatriots to Come to the Mainland or other valid documents;

(II) The traveler carried a forged Travel Permit for Mainland Residents to Go to Hong Kong and Macao, or Travel Permit for Hong Kong and Macao Compatriots to Come to the Mainland, or one that belongs to another person;

(III) The traveler refuses to present his/her documents for examination.  Cases of the second category given above shall be handled in accordance with provisions in Article 26 of the present Regulations.


Article 26 of Provisional Regulations Regarding Chinese Citizens’ Travels to the Hong Kong and Macao Regions for Personal Affairs:  Forged or altered Travel Permits for Mainland Residents to Go to Hong Kong and Macao, Travel Permits for Hong Kong and Macao Compatriots to Come to the Mainland or Entry and Exit Permits, or permits used by persons other than their holders shall be confiscated. In addition, the offender shall be served a warning or detained for not longer than 5 days, according to the seriousness of the circumstances.

Article 24 of Regulations Regarding Chinese Citizens’ Travels to the Taiwan Region: In the following cases, officials of border check posts have the power to prevent the persons in question from entering or exit China:

(I) The traveler does not carry valid travel documents;

(II) The traveler carries invalid travel documents, such as forged or altered ones;

(III) The traveler refuses to present his/her travel documents for examination;

(IV) The traveler is forbidden to enter or exit China by provisions in Articles 12 and 22 of the presents Regulations.

Article 33 of Regulations Regarding Chinese Citizens’ Travels to the Taiwan Region:  In addition to being punished in accordance with provisions in Article 23 of Rules Governing the Implementation of the Law of the People’s Republic of China on Exit and Reentry of Chinese Citizens, those who try to enter or exit China with forged or altered travel documents, or invalid travel documents, or documents belonging to other persons shall be fined not less than 100 yuan but not more than 500 yuan RMB, which may be combined with other punishment.

Article 24 of the Law of the People’s Republic of China on Entry and Exit of Aliens: Border check posts have the power to withhold exit of aliens coming under any of the following categories and to subject them to rules of the law:

(I) Those who carry invalid exit documents;

(II) Those who carry exit documents belonging to other persons;

(III) Those who carry forged or altered exit documents


Article 12 of the Law of the People’s Republic of China on Entry and Exit of Aliens: Border check posts have the power to withhold exit or entry of aliens coming under any of the following categories:

(I) Those who do not carry valid passports, documents or visas;

(II) Those who carry passports or documents that are forged, altered or belong to other persons;

(III) Those who refuse to present their documents for inspection;

(IV) Those who by notice from the Ministry of Public Security or Ministry of National Security are not permitted to enter or exit China.
