Foreigners of the following categories are not permitted to exit China:

1. Defendants in criminal cases, or persons who, the public security organ or the people’s procuratorate or the people’s court believe, are criminal suspects;

2. Persons who, by instructions from a people’s court, are not permitted to leave China because of unsettled civil cases;

(3) Those who have otherwise violated Chinese laws and, the department concerned believes, should be brought to justice but have not been dealt with yet.

 The border check post has the right to withhold the following foreigners’ exit from China:

1. Those who do not hold a valid passport, document or visa;

2. Those whose passport or document have been forged, altered or belong to somebody else;

3. Those who refuse to present their documents for examination;

4. Those who are forbidden to exit China by instructions from the Ministry of Public Security or Ministry of National Security.
